Daniel E. Burgoyne joined Roberts, Carroll, Feldstein & Peirce, Inc. in September 2007, and practices in the firm’s litigation group in the areas of debtors’ and creditors rights, insurance defense, and general civil litigation.  He routinely appears before state and federal courts in both Rhode Island and Massachusetts.

 

Mr. Burgoyne’s debtor/creditor practice focuses upon representation of banks and other creditors in commercial lending and work-out matters, finding creative and cost-effective ways to secure payment of his clients’ claims.  Mr. Burgoyne is familiar with the unique Rhode Island receivership process, as well as bankruptcy proceedings in chapters 7, 11, and 13 of the U.S. Bankruptcy Code.  Significant positive results in this area of practice include

  • a favorable decision preserving the priority of his client’s mortgages over competing mechanic’s lien claimants;
  • attachment of the insurance receivables of a medical practice against whom his client, a former employee, had obtained a sizeable judgment;
  • securing the dismissal of a Chapter 11 Bankruptcy petition, on behalf of a secured creditor, after an evidentiary hearing on the feasibility of the debtor’s reorganization.

Mr. Burgoyne also practices in the firm’s insurance defense and general litigation practice, and has experience with personal injury, insurance coverage disputes, appellate litigation, probate administration, landlord-tenant, and professional malpractice. 

 

Mr. Burgoyne recently assisted as Rhode Island counsel for GTE Reinsurance Company, Ltd. in implementing the first commutation plan under Rhode Island’s Voluntary Restructuring of Solvent Insurers Act —the only statute of its kind in the United States. 

 

Prior to joining the firm, Mr. Burgoyne served as a judicial law clerk for the Honorable Michael A. Silverstein on the Business Calendar of the Rhode Island Superior Court.  Mr. Burgoyne is admitted to practice in all state and federal courts in Rhode Island and Massachusetts including the U.S. Court of Appeals for the First Circuit.  In 2003, he received a B.A. in quantitative economics and mathematics from Providence College, where he graduated magna cum laude.  He received his J.D. in 2006 from Boston College Law School.

 

Mr. Burgoyne volunteers with the Narragansett Council of the Boy Scouts of America.  He is also an avid hiker and is working to complete the Appalachian Mountain Club’s New England Hundred Highest Club by hiking the hundred tallest peaks in New England.
